1. Agreement to Terms
By accessing or using VOYD Fitness, you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, you may not use our services. These terms apply to all visitors, users, and others who access the app.
2. Health & Medical Disclaimer
Use of VOYD Fitness is at your own risk.
- Not Medical Advice: VOYD Fitness, including its AI Coach, provides general fitness and nutritional information. This is not a substitute for professional medical advice, diagnosis, or treatment.
- Doctor Consultation: Always consult a qualified medical professional before starting any new exercise or nutritional program, especially if you have pre-existing health conditions.
- AI Guidance: Our AI Coach provides automated insights. While we strive for accuracy, AI-generated content may occasionally contain errors. Never rely solely on AI for health decisions.
- Immediate Stop: If you feel pain, dizziness, or shortness of breath while exercising, stop immediately and seek medical attention.
3. Subscriptions & Payments
VOYD Fitness offers premium features through paid subscriptions managed via RevenueCat. By subscribing, you agree to the following:
- Billing: Payments are processed through the Apple App Store or Google Play Store. Your account will be charged upon confirmation of purchase.
- Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
- Cancellation: You can manage and cancel your subscription anytime in your App Store or Google Play account settings.
- Refunds: All refund requests are handled exclusively by Apple or Google. VOYD Fitness cannot directly issue refunds for store-processed transactions.
4. User Accounts
To use our backend services, you must create an account. You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately if you suspect any unauthorized use of your account.
5. Intellectual Property
The VOYD Fitness app, including its original content, features, AI templates, and branding, is the exclusive property of VOYD Fitness. You may not reproduce, distribute, or create derivative works from our platform without express written permission.
6. Limitation of Liability
To the maximum extent permitted by law, VOYD Fitness shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the app, including but not limited to physical injury, data loss, or inaccuracies in AI-generated coaching.
7. Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of significant changes by updating the "Last Updated" date at the top of this page. Continued use of the app after changes constitutes acceptance of the new terms.
8. Apple App Store Additional Terms
If you downloaded VOYD Fitness from the Apple App Store, the following additional terms apply:
- Acknowledgment: You acknowledge that these Terms of Use are concluded between you and VOYD Fitness only, and not with Apple Inc. ("Apple"). VOYD Fitness, not Apple, is solely responsible for the App and the content thereof.
- Scope of License: The license granted to you for the App is a non-transferable license to use the App on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
- Maintenance and Support: VOYD Fitness is solely responsible for providing any maintenance and support services with respect to the App. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
- Warranty: VOYD Fitness is solely responsible for any product warranties, whether express or implied by law. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
- Product Claims: You acknowledge that VOYD Fitness, not Apple, is responsible for addressing any claims of you or any third party relating to the App or your possession and/or use of the App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
- Intellectual Property Rights: In the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, VOYD Fitness, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
- Legal Compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third-Party Beneficiary: You and VOYD Fitness acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms of Use, and that, upon your acceptance of the terms and conditions of these Terms of Use, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms of Use against you as a third-party beneficiary thereof.
